Total Performance Lasers — Duality Series Pre-Order Deposit Terms

By placing this order and submitting a deposit, you (“Buyer”) agree to the following terms with Total Performance Lasers LLC. (TPL)

1. Non-Refundable Deposit

The amount of 3000.00 paid at Checkout is a NON-REFUNDABLE deposit to reserve a production slot for a Total Performance Lasers Duality Series laser system.

This deposit is non-refundable under all circumstances, including but not limited to:

Order cancellation
Change of mind
Timeline changes
Shipping delays
Specification revisions
Business closure
Project cancellation

The deposit immediately covers engineering allocation, procurement, scheduling, and administrative costs.

2. Application Toward Purchase

The 3000.00 deposit will be applied toward the final purchase price.

Remaining balance will be invoiced prior to shipment. Failure to complete payment within the invoiced timeframe may result in:

Order cancellation
Loss of production position
Forfeiture of deposit

3. Production Timeline (Estimated)

Projected early shipping and delivery for pre-order customers is expected to begin by July 2026 or sooner.

Full production ramp is anticipated to begin around September 2026.

These dates are estimates only and are subject to change due to:

Supply chain conditions
Engineering refinement
Manufacturing constraints
Logistics factors
Force majeure events

Timeline adjustments do not constitute grounds for refund, cancellation, or dispute.

4. Product Evolution & Specification Changes

Buyer understands the Duality Series is a high-performance evolving platform. TPL reserves the right to improve or modify:

Components
Features
Design elements
Materials

without notice when such changes enhance performance or reliability.

5. Transferability

Deposits:

Are not transferable to another party
Cannot be reassigned or resold
Cannot be applied to unrelated products without written approval

6. Limitation of Liability

TPL shall not be liable for indirect or consequential damages including:

Lost profits
Business interruption
Production downtime
Project delays

resulting from participation in this pre-order.

7. Governing Law

These terms are governed by the laws of the State of Florida.

8. Acceptance

By completing checkout, Buyer acknowledges:
